The regional court in the state of Schleswig-Holstein ruled that the charge of rebellion can not be honoured in Germany "because the criteria of "violence" is not present".

Nevertheless, Puigdemont's defence team were "very happy for our client" that the "outrageous" charge of rebellion had been set aside, Dunckel said.

A German court has rejected an extradition request for Catalonia's former leader Carles Puigdemont on the charge of rebellion for his role in the campaign for the region's independence.

A Spanish official said the government in Madrid respected judicial decisions "always, when it likes them and when it doesn't".

The German judges will consider Puigdemont's extradition on the less serious charge of misusing public funds.

German prosecutors argued earlier this week that the main charge of rebellion is equivalent to Germany's criminal offense of treason.

Puigdemont can leave prison as soon as he posts the bail, a court spokeswoman said on Thursday.


He has been in self-imposed exile from Spain since late previous year - and was arrested on foot of a European Arrest Warrant by German authorities at the Danish border last month.

The court has been considering what to do about a Spanish extradition request for Mr Puigdemont for more than a week.

The official added: "Spanish justice will adopt the appropriate measures in the face of these new circumstances".

"That is not the case here", the court said in a statement.

He was trying to drive from Finland to Belgium, where has been living since fleeing to escape arrest in Spain.
