European Union to move on Brexit talks, Irish 'riddle' remains

Initially, the second phase of Brexit talks will be dominated by discussions over the transition period, under which the United Kingdom will continue to abide by European Union law for roughly two years, but not have a role in any decision-making institutions.

Talks on phase two are set to begin in January.

"It is now time for internal EU-27 preparations and exploratory contacts with the United Kingdom, to get more clarity on their vision", European Council president Donald Tusk told reporters after the meeting. "We have to make sure [a country that leaves] doesn't stay in a transition stage for ever - it wouldn't work for either the United Kingdom, nor the EU", Irish prime minister Leo Varadkar told press after the meeting.

The EU's rules for transition include complying with EU trade policy, which means the United Kingdom could start its own bilateral trade negotiations (but cannot conclude them before the transition period ends), and can ask the EU and third parties to roll-over existing trade accords.

Speaking in her Maidenhead constituency, Mrs May told the Press Association the move to the second phase of talks represented "an important step on the road to delivering the smooth and orderly Brexit that people voted for in June of last year".

After Britain officially exits the EU on March 29, 2019 it will lose its seat on the European Council, the body representing the 28 member states.

And time is tight.

In a separate tweet she promised "securing the greatest possible access to European markets, boosting free trade with countries across the world, and delivering control over our borders, law and money" in the Brexit deal.

Juncker said: "Now it's up to us to draft a Withdrawal Agreement together with our British friends and I hope that this withdrawal treaty will be approved and by the European Parliament and by the House (of Commons) in London".

A British government official said the prime minister was approaching the next phase, which will discuss a transition period as well as the terms of the future trading relationship, "with ambition and creativity".

Meanwhile, her hopes of avoiding a second Commons defeat over Brexit also improved after senior Tory backbenchers from both the Leave and Remain factions appeared to be ready to back a compromise over Mrs May's plan to write the date the United Kingdom leaves the European Union into law.

"We will give the mandate for preparation for the Commission and ourselves for the negotiations for the future of our relations", Lithuanian President Dalia Grybauskaite said, seeing those talks formally starting in March.

Backbenchers, including former minister Oliver Letwin, have tabled an amendment, suggesting a change to the legislation.

Senior sources are confident they can see off a defeat, after No 10 said there were no plans to take the date out of the bill.

But several hours later as leaders reconvened, European Commission President Jean-Claude Juncker and Italy's Prime Minister Paolo Gentiloni warned that the hardest decisions were still to come as Britain tries to extricate itself from rules agreed over years in the bloc.
