Sabarimala temple case Supreme Court refers matter to Constitution bench

The Supreme Court today is expected to pronounce order on entry of women in Kerala's Sabarimala temple.

"Since last couple of months, we have been seeing that the Supreme Court is bringing out several progressive and landmark judgments". Probed further on the board's stand, he went on to add: "Even if the court says the women of any age can enter the hills shrine, the member of a dignified, decent family with self respect will not enter the temple".

The Supreme Court on Friday referred to its constitution bench the matter pertaining to a ban on the entry of women at Kerala's Sabarimala temple.

A bench of Chief Justice Dipak Misra, Justice R. Banumathi and Justice Ashok Bhushan also framed six questions to be addressed by the Constitution Bench. Challenging the ban restrictions on entry of women into the Sabarimala temple, the top court has been hearing a Public Interest Litigation (PIL).

The temple, situated in the Pathanamthitta district of Kerala, restricts women aged between 10 and 50 from visiting the premises.


Article 14 guarantees right to equality, Article 15 prohibits discrimination on grounds of religion, race, caste, sex or place of birth, and Article 17 abolishes untouchability and forbids it practice. The apex court will examine whether this amounts to discrimination against women.

Questioning the age-old custom, the Supreme Court in July had said, "A temple is a public religious place and can not refuse entry to a woman". Initially, the LD Government followed the women's entry into the temple in 2007, which was later turned over to UDF Government. So Women should be permitted inside the Sabarimala temple.

The Constitution bench now has to decide.

Whether Rule 3 (b) of Kerala Hindu Places of Public Worship (Authorization of Entry) Rules, 1965 is ultra vires the Kerala Hindu Places of Public Worship (Authorisation of Entry) Act, 1965 and, if treated to be intra vires, whether it will be violative of the provisions of Part III of the Constitution?
