As I predicted in my Facebook Live and Equifax web assistance story last Friday, Equifax has eliminated that goofy (and unenforceable, according to New York's attorney general) "waive your legal rights" clause from its offer of free credit monitoring in the wake of the credit bureau's massive consumer data breach.

But what do you do once your report is frozen and you need, say, a credit card company to look at it? The company has set up a website where people can check whether their personal information potentially was affected by the breach. The danger is that cyber hoods will use the data to make purchases or establish credit that get billed to victims - people like you, perhaps you yourself.

"We have thus far seen no proactive effort on the part of Equifax to notify all affected consumers", she wrote.

You will then be asked to input your last name and the last 6 digits of your social security number. At that point you'll be given a date when you can return to the site and sign up for the service.

The site where Mashable uncovered the information is now offline. But it's unclear when or how you will receive that message. Monday is the first day you can sign up.

A freeze doesn't protect you from everything: thieves can still file a fraudulent tax return in your name or charge things to your already opened credit card accounts.


To defend themselves a company spokeswoman, Ines Gutzmer stated: "The three executives who sold a small percentage of their Equifax shares on Tuesday, August 1, and Wednesday, August 2, had no knowledge that an intrusion has occurred at the time they sold their shares". It's also working with law enforcement authorities in an ongoing criminal investigation. The fee is waived in some places for varying conditions, such as if someome has been a victim of identity theft or is on active duty for the military.

There was a catch: the supposedly free service required credit card information up front and would begin charging the card after the free trial ended unless users proactively canceled, according to terms of use for the product dated September 6. It lasts for 90 days and requires creditors to get in contact with the person before checking their credit. But one way to stop those types of attempts from succeeding is by "freezing" your credit report, which means no entity can access it without your approval.

A freeze takes your credit report out of circulation.

"This is major. Because it's a credit reporting agency", Zafar said. Each charges $5 to $10 to freeze an account, and they will provide a PIN number that will allow you to lift the freeze.

The complaint also cites the fact that the company took more than a month before making the breach public and they were not able to disclose the reason why.

That's the fix Equifax (EFX) finds itself in after bungling its response to its massive breach, which is fueling consumer outrage and calls for greater regulation over credit-reporting agencies, which include Experian (EXPGY) and TransUnion (TRU).
