Smith's death at the hands of Heaggan-Brown on August 13 sparked two nights of rioting in the Sherman Park neighborhood and highlighted the strained relationship between police and African-Americans in the city. Body-camera video showed Heaggan-Brown shooting Smith in the arm as he threw his gun over a fence.

Smith - who had a "lengthy arrest record" - was lying on the ground when he received another shot that killed him. But Heaggan-Brown's attorneys played bodycam video to show the two shots he fired came just 1.69 seconds apart - illustrating how little time the officer had to decide.

Smith's family members were devastated and angry about the cop's acquittal as they stormed out of the courtroom. "It's a decision the community had to make", Chisholm said.

Smith was killed in August 2016 after fleeing a traffic stop.


According to Fox6Now, the jury returned the not guilty verdict on a charge of first-degree reckless homicide after entering into a second day of deliberations on Wednesday.

The family's attorney, David Owen, said he has filed a lawsuit against Heaggan-Brown and the city of Milwaukee.

Using frame-by-frame video from the officers' body cameras, prosecutors argued that while the first shot fired by Mr. Smith was reasonable, the second shot was not.

The case is one of several involving the police shooting of black men that has sparked protests nationwide.

In Heaggan-Brown's bodycam video, he began chasing Smith immediately after stepping out of his patrol vehicle. According to Fox6, jurors also had the option to pick from two lesser charges instead of first-degree reckless homicide.

The two shots by Heaggan-Brown came in quick succession, striking Smith once in his right arm and then the fatal shot to the chest.

And all six Baltimore officers charged over the 2015 death of Freddie Gray, due to spinal cord injuries suffered in the back of a police van, were eventually cleared.
