Justice minister bids to reshape Supreme Court

Richard Burr this week became the latest to pledge he'll stonewall Clinton's nominee for the current Supreme Court vacancy if she beats Donald Trump.

Indeed, by some measures, Burr was even more blunt on the subject than Cruz - while the Texan was cagey about his specific intentions, the North Carolinian was unambiguous about keeping a Supreme Court vacancy in place unless voters elect a president of his own party.

After the death of Justice Antonin Scalia in February the court has been down to eight members.

"The Constitution really shouldn't mean different things in different parts of the country", said Pamela Karlan, a former U.S. Department of Justice official and Stanford University law professor. The legal term for what happens next is called "affirmed by an equally divided court". If a worthy case needs deciding at the national level, the justices should resolve the controversy and give lower courts and the people a final answer.

Shaked informed Naor of her intention, and made clear that unless they reach an agreed solution then Naor will not have her way over the appointment of even two of the four new justices, and Shaked will see to it that all four will be her appointees.

As of midday Tuesday, Ross had yet to address Burr's comments on the Supreme Court. I would note, just recently, that Justice Breyer observed that the vacancy is not impacting the ability of the court to do its job. Ted Cruz (R-Texas) weighed in, effectively endorsing the same idea, telling reporters there's a "long historical precedent" for a Supreme Court with fewer than nine justices. Mrs Clinton, meanwhile, says a Supreme Court shaped by her opponent would doom "the future of the planet".

Justices on the Florida Supreme Court will Tuesday morning hear arguments about whether a state law requiring women to see a doctor 24 hours before having an abortion should continue to be blocked by court order - as it has for most of the previous year and a half - or should go into effect.

That this overwhelming majority of conservative appointments has not led to a substantial decline in women's right to choose abortion may reflect how we feel on this issue as a nation. "This is going down a very unsafe road", he said.

"If Hillary Clinton becomes president, I am going to do everything I can do to make sure four years from now, we still got an opening on the supreme court", Burr told Republican volunteers in a private meeting, according to leaked audio first reported by CNN.

Now the debate has shifted, as several Republican senators have suggested simply not allowing any Democratic selections to the Supreme Court at all. There is one more issue that should be on everyone's mind, though, and that is the Supreme Court.

"There's a difference between what might be constitutional and what you could do politically and what you should do", Flake told Politico.

Two weeks ago Sen. In an unprecedented step earlier this year, Senate Republicans refused to hold hearings for Obama nominee Merrick Garland, arguing instead that American voters should have a say in the process by voting in a new president and letting that person nominate the next justice. If Democrats take back the Senate majority, it will play out in fairly predictable fashion: Republicans will filibuster whoever President Clinton nominates, then the Democratic Senate will change the rules to outlaw filibusters of Supreme Court justices.
